1. INTRODUCTION

These Terms and Conditions govern your use of the BXE website, CRM platform, and related services. By accessing or using our services, you agree to be bound by these terms. If you do not agree, you may not use the platform.

2. DEFINITIONS

  • “BXE” refers to BXE (Pty) Ltd, a South African CRM and marketing services provider.

  • “User”, “You”, or “Client” refers to anyone who accesses or uses BXE's services.

  • “Services” means all offerings provided via our website or platform, including CRM, lead generation, automation, and consulting.

3. ELIGIBILITY

To use our platform, you must:

  • Be at least 18 years old

  • Have the legal capacity to enter into agreements

  • Agree to comply with these terms and all applicable laws

4. SERVICES OFFERED

BXE provides:

  • CRM software for client and lead management

  • Campaign automation tools (email, SMS, WhatsApp)

  • Landing page and form builders

  • Data analytics and reporting tools

  • API integrations and support

Services may be updated or modified at our discretion.

5. USER RESPONSIBILITIES

As a user, you agree to:

  • Provide accurate and up-to-date information

  • Keep your login credentials secure

  • Use the platform lawfully and ethically

  • Only upload, store, or send data you are legally allowed to process

  • Ensure all leads or customer contacts in your database have consented to receive communications (in line with POPIA and other laws)

6. PAYMENT & BILLING

Certain services are offered on a paid subscription basis.

  • Pricing will be communicated prior to sign-up

  • All fees are billed monthly or annually in advance

  • Failure to pay may result in suspension or termination of your account

  • BXE reserves the right to update pricing with prior notice

7. DATA PRIVACY & SECURITY

We respect your privacy and handle your data according to our Privacy Policy.

You retain ownership of your uploaded data. However, by using BXE’s services, you grant us permission to process and store that data for the purpose of delivering the service.

All marketing activities conducted via our system must comply with POPIA, CPA, and other applicable laws.

8. INTELLECTUAL PROPERTY

All content, software, designs, and materials on the BXE platform are the intellectual property of BXE (Pty) Ltd.

You may not copy, modify, distribute, or use our materials without written permission.

9. LIMITATION OF LIABILITY

BXE shall not be liable for:

  • Any loss of income, business, or data

  • Indirect or consequential damages

  • Delays or interruptions beyond our control

Use of our platform is at your own risk. While we strive for uptime and accuracy, no software is completely free from errors or outages.

10. TERMINATION

We may suspend or terminate your account if:

  • You breach these terms

  • You misuse the platform

  • Required payments are not made

You may also cancel your account at any time. Upon termination, we reserve the right to delete your data after a reasonable period.

11. MODIFICATIONS TO TERMS

BXE may revise these Terms and Conditions periodically. Updates will be posted on our website with an updated “Effective Date.”

Continued use of the platform after changes implies acceptance of the new terms.

12. GOVERNING LAW

These terms are governed by the laws of the Republic of South Africa.
Any disputes will be subject to the jurisdiction of South African courts.
